By creating an account, purchasing a subscription or using Future Kernel POS, you agree to these Terms & Conditions.

Eligibility and accounts

You must be at least 18 years old and authorised to act for the registered business. You must provide accurate information, protect login credentials and promptly notify us of suspected unauthorised access. You are responsible for users and activity within your business workspace.

The service

We provide cloud-based POS, inventory, customer, reporting and related business tools according to the selected package. Features, limits and supported integrations may vary by plan. Internet access and compatible devices are your responsibility.

Subscriptions and payment

Prices, billing periods, taxes and package limits are displayed before purchase. Access begins when the subscription is approved. Unless otherwise stated, a subscription applies only for its stated period. Where recurring billing is enabled, you authorise the applicable renewal charge until cancellation. Failed or overdue payments may result in restricted access.

Trials

Any trial is subject to the displayed duration and limits. We may restrict repeated trials by the same person, business, device or contact information. At the end of a trial, a paid subscription may be required to continue using subscription features.

Acceptable use

You must not use the service unlawfully; attempt to bypass package limits or security controls; interfere with the service; upload malicious material; access another customer’s data; reverse engineer protected components; or use the platform to facilitate fraud, abuse or prohibited goods and services.

Your data and responsibilities

You retain responsibility for the accuracy, legality and appropriate backup or export of business data entered into the service. You must obtain required permissions for customer, employee and supplier information. You authorise us to process this data as needed to provide and secure the service.

Third-party services

Payment gateways, SMS providers, couriers, printers and other integrations may have separate terms, fees and availability. We are not responsible for third-party outages, decisions or services outside our control.

Availability and changes

We work to provide a reliable service but do not guarantee uninterrupted or error-free operation. Maintenance, security events, internet failures or circumstances beyond reasonable control may affect availability. We may improve, replace or discontinue features while taking reasonable steps to avoid material disruption.

Suspension and termination

We may suspend or terminate access for non-payment, unlawful activity, security risk or material breach of these Terms. When a subscription expires or ends, access may be restricted. Data retention and deletion are governed by our operational and legal requirements.

Disclaimer and liability

The service is provided on an “as available” basis to the extent permitted by law. You are responsible for reviewing sales, tax, inventory and accounting outputs before relying on them. To the maximum extent permitted by law, we are not liable for indirect, incidental or consequential loss, lost profit, lost opportunity or loss caused by third-party services.

Refunds, privacy and changes

Our Refund Policy and Privacy Policy form part of these Terms. We may update these Terms when the service or applicable requirements change. Continued use after an updated version becomes effective constitutes acceptance of the revised Terms.

Governing law and contact

These Terms are governed by the laws of Sri Lanka, and disputes are subject to the jurisdiction of the competent courts of Sri Lanka. Questions may be sent to support@futurekernel.com.
